1. Introduction

These Terms and Conditions ("Terms") govern your use of the PetStitch platform and services operated by Quantum Research Lab Kft. (registered in Hungary, 9700 Szombathely, Vaci Mihaly utca 28/4, EU VAT: HU32123564).

By accessing or using our service, you agree to be bound by these Terms. If you do not agree, please do not use our service.

2. Service Description

PetStitch is an AI-powered platform that converts pet photographs into digital embroidery designs. Our service includes:

• AI-generated embroidery design files based on your uploaded pet photos
• Digital delivery of design files in multiple embroidery formats (PES, DST, JEF, EXP, VP3)
• Product mockup previews showing how your design may look on apparel
• One free design generation per user, with additional designs available for purchase

Important: PetStitch provides digital embroidery design files only. We do not perform physical embroidery. The actual embroidery of designs onto apparel or other items is done by the customer through third-party service providers.

4. User Accounts

You may create an account using your email address or third-party authentication providers (Google, Facebook, Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Pricing & Payment

5.1 Pay-Per-Design

• Free Generation: Each user receives one (1) free embroidery design generation.
• Single Design: Additional designs are available for €9.99 per design, which includes all 5 embroidery file formats.

We offer the following subscription plans, billed monthly or annually:

5.3 Subscription Terms

• Billing Cycle: Subscriptions are billed at the beginning of each billing period (monthly or annually). Annual plans are billed as a single payment for the full year.
• Design Allowance: Unused designs do not roll over to the next billing period.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.
• Annual Plan Refunds: Annual subscriptions may be refunded within 14 days of purchase if no designs have been generated. After 14 days or after generating any design, no refund is available.
• Price Changes: We may adjust subscription prices with 30 days' notice. Existing annual subscriptions are honored at the original price until renewal.

5.4 General Payment Terms

• Payment Processing: All payments are securely processed by Stripe. Applicable taxes (VAT) are calculated and applied at checkout based on your location.
• Currency: All prices are displayed in EUR. Your bank may apply currency conversion fees.

6. Digital Delivery

Upon successful payment, your embroidery design files will be delivered digitally via email and available for download through your account. Files are available for download for 90 days from the date of purchase.

7. Intellectual Property

• Your Content: You retain all rights to the pet photos you upload. By uploading, you grant us a limited license to process these images solely for the purpose of generating your embroidery designs.
• Pet Photo Protection: We will never use your uploaded pet photos for marketing, social media, training, or any purpose other than generating your requested design. Your pet photos are processed and stored only for delivery purposes and deleted according to our retention policy.
• Generated Designs & Mockups — Our License: By using our service, you grant Quantum Research Lab Kft. a non-exclusive, royalty-free, worldwide license to use the generated designs and product mockups (not your original pet photos) for our own marketing, social media, website content, and to improve our design engine performance. If you do not wish your designs to be used in this way, you may contact us at hello@petstitch.art to opt out.
• User-Shared Content: If you voluntarily share your pet photos by tagging PetStitch on social media or by communicating them to us through other channels, you grant us permission to repost, feature, and use that content for promotional purposes.
• Generated Designs — Your License: Upon purchase, you receive a perpetual, non-exclusive license to use the generated embroidery designs for personal use, including creating physical embroidered items for yourself or as gifts.
• Commercial Use: The generated designs may not be resold, redistributed, or used for commercial mass production unless you hold an active Embroidery Business subscription, which grants a commercial license for designs generated during your subscription period.
• Platform Content: All other content on the PetStitch platform (branding, UI, text, illustrations) is the property of Quantum Research Lab Kft. and protected by copyright law.

8. AI-Generated Content

Our designs are generated using artificial intelligence. We use the best performing models (GPT-image, Gemini Pro, etc.) according to the latest research and our internal benchmarks. Due to the nature of AI generation:

• Results may vary and are not guaranteed to be identical to your expectations or reference images.
• Each generation produces a unique design. We cannot reproduce an exact previous result.
• We make reasonable efforts to ensure quality but cannot guarantee that every design will be suitable for embroidery on all fabrics or with all machines.

9. Acceptable Use

You agree not to:

• Upload images that you do not have the right to use
• Upload images containing illegal, offensive, or harmful content
• Attempt to reverse-engineer, exploit, or abuse our AI pipeline or infrastructure
• Use automated systems or bots to access our service
• Resell or redistribute design files without authorization

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our service.
• Our total liability for any claim related to our service shall not exceed the amount you paid for the specific design in question.
• We are not liable for the quality or outcome of embroidery work performed by any third-party service provider, including those listed on our platform.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Hungary, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our service shall be subject to the exclusive jurisdiction of the courts of Szombathely, Hungary.

For EU consumers: Nothing in these Terms affects your statutory rights under EU consumer protection law, including the right to bring proceedings in the courts of the EU Member State in which you are domiciled.

EU consumers may also use the European Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by notifying you via email. Continued use of the service after changes constitutes acceptance.

15. Privacy

Your use of our service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
